Part 8.4Enforcement—return and forfeiture of things seized

457 Forfeiture of seized thing

(1)

This section applies if—

(a)

anything seized under this chapter is not required to, or cannot, be returned under section 452; and

(b)

an application for disallowance of the seizure under section 455—

(i)

is not made within 10 days after the day the thing was seized; or

(ii)

is made within the 10-day period, but the application is refused or withdrawn before a decision in relation to the application is made.

(2)

If this section applies to the seized thing, the thing—

(a)

is forfeited to the Territory; and

(b)

may be sold, destroyed or otherwise disposed of as the MAI commission directs.
