55 Who may apply for defined benefits?

(1)

Any of the following people may make an application for defined benefits to the relevant insurer for a motor accident:

(a)

a person injured in the motor accident;

Note The person may be entitled to income replacement benefits, treatment and care benefits and quality of life benefits.

(b)

the dependant of a person who died as a result of the motor accident;

Note The dependant may be entitled to death benefits (see s 169).

(c)

the person who has paid, or is liable to pay, the funeral expenses of a person who died as a result of the motor accident.

Note The person may be entitled to funeral benefits (see s 178).

(2)

The following people may make an application for defined benefits on behalf of a person mentioned in subsection (1):

(a)

for an applicant for defined benefits who is a person with a legal disability—the applicant’s guardian;

(b)

for an applicant for defined benefits mentioned in subsection (1) (b)—the personal representative of the person who died as a result of the motor accident.
