58 Meaning of application period—ch 2

In this chapter:

application period, for an application for defined benefits, means—

(a)

for a person injured in a motor accident—the period of 13 weeks beginning on the date of the motor accident; or

Note 1 The person may be entitled to income replacement benefits, treatment and care benefits and quality of life benefits.

Note 2 The person would be able to make an additional later application for quality of life benefits (see s 137).

(b)

for a person who has paid, or is liable to pay, the funeral expenses of a person who died as a result of a motor accident—the period of 13 weeks beginning on the date of the injured person’s death; or

Note The person may be entitled to funeral benefits (see s 178).

(c)

for the dependant or personal representative of a person who died as a result of a motor accident—the period of 13 weeks beginning on the date of the injured person’s death.

Note The dead person’s dependants may be entitled to death benefits (see s 169).
