38 Dissolution of partnership by death, bankruptcy, charge etc

(1)

Subject to any agreement between the partners, a partnership is dissolved in relation to all the partners if a partner dies, becomes bankrupt, or executes a personal insolvency agreement under the Bankruptcy Act 1966 (Cwlth).

(2)

If a partner’s share in the partnership property is charged under this Act for the partner’s separate debt, the other partners may dissolve the partnership.
