106 EIS—declaration by Minister
(1)
The Minister may, in writing, declare that an EIS must be undertaken for a development proposal.
(2)
However, the Minister must not make a declaration in relation to the development proposal unless satisfied on reasonable grounds that there is a risk of significant adverse environmental impact from the proposed development.
Note The Minister may publish guidelines about how the Minister will exercise power under this section (see s 519).
