107 Effect of declaration made after development application
(1)
This section applies to a development application if, after the application is made—
(a)
either—
(i)
the Minister makes a declaration under section 106 in relation to the development proposal to which the application relates; or
(ii)
the Public Health Act Minister makes a declaration under the Public Health Act 1997, section 134 in relation to the application; and
(b)
the application does not satisfy the application requirements for a development requiring environmental impact assessment.
(2)
The development application is taken to have been withdrawn.
(3)
The territory planning authority must give the applicant notice of the effect of this section.
