200 Effect of ACAT application on reconsideration
This section applies if, after a reconsideration application is made, an application is made to the ACAT for review of the original decision.
If the application to the ACAT is made by a third party, the reconsideration application is taken to be withdrawn.
However, if the ACAT makes an order dismissing or striking out the application to the ACAT, the applicant for the reconsideration application may make another reconsideration application not later than 20 working days after the day the order takes effect.
In this section:
third party means an entity other than the applicant for the development approval or the territory planning authority.
