58 Providing professional engineering service without registration
A person commits an offence if the person—
carries out a professional engineering service other than under the direction and oversight of a professional engineer who is responsible for the service; and
is not registered to carry out the professional engineering service; and
is reckless about whether the person is registered to carry out the professional engineering service.
Maximum penalty: 100 penalty units.
A person commits an offence if the person—
carries out a professional engineering service other than under the direction and oversight of a professional engineer who is responsible for the service; and
is not registered to carry out the professional engineering service.
Maximum penalty: 50 penalty units.
An offence against subsection (2) is a strict liability offence.
