125 Procedure

(1)

An investigation must be conducted with as little formality and technicality as a proper consideration of the matter permits.

(2)

An investigation need not involve a hearing (whether public or private).

(3)

An investigation must be conducted in accordance with any applicable code of practice.

(4)

For the purposes of an investigation, the chief health officer—

(a)

is not bound by the rules of evidence; and

(b)

must observe the rules of natural justice.

(5)

A person appearing for the purposes of an investigation may be represented by any other person, subject to any applicable code of practice.
