Division 3.1General

20 Compliance with codes of practice

(1)

A person carrying on a public health risk activity must not, without reasonable excuse, fail to comply with a code of practice in relation to that activity.

Maximum penalty:

(a)

for a person who is not a utility—50 penalty units, imprisonment for 6 months or both; or

(b)

for a utility—2 000 penalty units, imprisonment for 6 months or both.

(2)

A person performing a public health risk procedure must not, without reasonable excuse, fail to comply with a code of practice in relation to that procedure.

Maximum penalty:

(a)

for a person who is not a utility—50 penalty units, imprisonment for 6 months or both; or

(b)

for a utility—2 000 penalty units, imprisonment for 6 months or both.
