40 Activity licence—emergency suspension
The grounds for the suspension of an activity licence under this section are as follows:
contravention by the licensee or any defined influential person in relation to the licensee of a condition to which the licence is subject;
subject to section 41, the giving of a prohibition notice to the licensee.
The Minister may, by notice in writing given to the holder of an activity licence, suspend the licence for a period not exceeding 6 months where the Minister has reasonable grounds for believing that—
there exists a ground for the suspension of a licence under this section; and
it is necessary to suspend the licence in order to prevent or remove an imminent serious risk to public health.
A suspension takes effect on the date on which the notice is given to the licensee.
A notice of suspension must—
specify the ground upon which the licence is suspended; and
specify the period of the suspension; and
state the facts and circumstances that, in the Minister’s opinion, constitute that ground.
