150 Meaning of public sector member etc
In this Act:
public sector member—
means the following:
a statutory office-holder;
Statutory office-holder—see the Legislation Act, dictionary, pt 1.
A statutory office-holder may also be a public servant.
a person employed by a statutory office-holder;
if a statutory office-holder enters into an arrangement with the head of service under a territory law for the use of the services of a public servant—the public servant; but
does not include the following:
the Chief Justice or a judge;
the Chief Magistrate, a magistrate or any office that must be occupied by a magistrate;
a person mentioned in paragraph (a) to the extent that the person exercises a judicial function;
an ACAT tribunal member to the extent that the member exercises a function in relation to a hearing of a proceeding before the ACAT;
a prescribed person.

A management standard may prescribe that a person is a public sector member (see s 156).
