114 Minister may exempt people, radiation sources etc
The Minister may exempt a person, a radiation source or a dealing with a radiation source from this Act if the Minister is satisfied that the person’s conduct, the radiation source or the dealing does not pose a significant risk to the health or safety of people or of damage to property or the environment.
A reference to an Act includes a reference to a provision of an Act (see Legislation Act, s 7 (3)).
A regulation may also provide for exemptions (see s 123).
An exemption may be conditional.
An exemption under subsection (1) has no effect to the extent that it is inconsistent with a regulation.
An exemption is a disallowable instrument.
In deciding whether to exempt a person, radiation source or a dealing with a radiation source, the Minister must take into account any criteria prescribed by regulation.
