46J Offence—using or disclosing information in supporting documents without authorisation

(1)

A person commits an offence if—

(a)

the person uses, or discloses to someone else, any information contained in a supporting document for a family violence termination notice; and

(b)

the use or disclosure is not authorised or required under a law applying in Australia.

Maximum penalty: 20 penalty units.

(2)

Subsection (1) does not apply if the use or disclosure—

(a)

is between 2 or more of the following:

(i)

the lessor;

(ii)

the lessor’s agent;

(iii)

an employee of the lessor’s agent;

(iv)

the Territory; or

(b)

is reasonably necessary to obtain legal advice from a lawyer.

Note The defendant has an evidential burden in relation to the matters mentioned in s (2) (see Criminal Code, s 58).
