55 Repudiation without vacation

On application by a lessor, the ACAT may make a termination and possession order if—

(a)

the tenant repudiates the residential tenancy agreement in writing; and

(b)

the lessor accepts the repudiation as proposed by the tenant; and

(c)

the tenant fails to vacate the premises on or before the date specified for vacation in the notice of repudiation.
