A resident of a retirement village may, from time to time, appoint a person as the proxy of the resident.
The appointment must be made in the way prescribed by regulation.
A person is not the proxy of a resident of a retirement village for this Act unless the person is appointed under this section.
An appointment of the operator of a retirement village or close associate of the operator as a proxy is void.
A person appointed as the proxy of a resident of a retirement village cannot vote on a matter on the resident’s behalf if the resident personally votes on the matter.
This section applies despite the terms of the instrument appointing a person as the proxy of the resident.
This section does not apply to residents of a retirement village that is subject to a units plan.
