74 Ending appointment of advisory committee members
This section applies to an advisory committee member other than the surveyor-general.
The Minister must end the appointment of an advisory committee member if—
the Minister becomes aware that the member—
has failed to comply with section 67 (Disclosure of interests by advisory committee members) without reasonable excuse; or
has at any time been convicted, in Australia, of an offence punishable by imprisonment for 1 year or longer; or
has at any time been convicted, outside Australia, of an offence that, if it had been committed in the ACT, would be punishable by imprisonment for 1 year or longer; or
satisfied that the member is no longer qualified to be appointed to the member’s position.
The Minister may end the appointment of an advisory committee member—
if the member is absent from 3 consecutive meetings of the advisory committee other than on approved leave; or
if the member contravenes a territory law; or
for misbehaviour; or
for physical or mental incapacity, if the incapacity substantially affects the exercise of the member’s functions.
A person’s appointment also ends if the person resigns (see Legislation Act, s 210).
