Damage etc to be minimised
41L Damage etc to be minimised
In the exercise, or purported exercise, of a function under this part, an authorised officer must take reasonable steps to ensure that they, and any person assisting them, cause as little inconvenience, detriment or damage as possible.
If an authorised officer, or a person assisting them, damages anything in the exercise or purported exercise of a function under this part, the authorised officer must give written notice of the details of the damage to the person they believe on reasonable grounds is the owner of the thing.
If the damage occurs on premises entered under this part in the absence of the occupier, the notice may be given by securing it in a conspicuous place at the premises.
