Tobacco and Other Smoking Products Act 1927

For this Act, the publication of the name of a manufacturer, distributor or retailer of smoking products—

is not, of itself, a smoking advertisement; and

is not taken, of itself, to publicise or promote—

a smoking product, or the purchase or use of a smoking product; or

a trademark or brand name of a smoking product; or

the name or interests of a manufacturer or distributor of a smoking product in association with a smoking product.

However, the publication of the name of a manufacturer, distributor or retailer of smoking products in association with the publication of other material may be either or both of the following:

a smoking advertisement;

taken to be publicity or promotion as mentioned in subsection (1) (b).
