9 Location of smoking products
A smoking product for sale at a retail or wholesale outlet must be located—
at a point of sale for the outlet; and
on the seller’s side of the point of sale, not less than 1m away from any part of the customer service area in relation to the point of sale.
A price ticket for a product line for sale (or usually available for sale) at a point of sale at a retail or wholesale outlet must be located not less than 1m away from any part of the customer service area in relation to the point of sale.
An occupier of a retail or wholesale outlet commits an offence if the occupier contravenes subsection (1) or (2).
Maximum penalty: 50 penalty units.
An offence against this section is a strict liability offence.
