32 Ending appointments
The Minister may end a member’s appointment—
(a)
for misconduct; or
(b)
if the member is convicted, or found guilty, of an indictable offence; or
(c)
if the member is convicted, or found guilty, of an offence that, if it had been committed in the ACT, would be an indictable offence; or
(d)
if the member is unable to exercise the member’s functions under this Act.
Note A conviction does not include a spent conviction or an extinguished conviction (see Spent Convictions Act 2000, s 16 (c) (i) and s 19H (1) (c) (i)).
