140 Application for review taken to be withdrawn if individual dies

(1)

This section applies if—

(a)

an application for review of a reviewable decision is made under section 136; and

(b)

the individual about whom the reviewable decision was made dies.

(2)

The application is taken to be withdrawn.

(3)

The registrar must, as soon as practicable after becoming aware of the individual’s death, give notice of the withdrawal to—

(a)

any person who was given notice of the application under section 139; and

(b)

any other person the ACAT directs a copy of the notice be given to.
