Each witness to the signing of an individual’s second request must certify in writing that—

if the request was signed by the individual making the request—

the request was signed by the individual in the presence of the witness; and

the individual appeared to sign the request voluntarily and without coercion; and

if the request was signed by an agent in the presence of the witness—

the individual appeared to ask, voluntarily and without coercion, the agent to sign the request; and

the request was signed by the agent; and

the witness is not knowingly an ineligible witness.

Note It is an offence to make a false or misleading statement, give false or misleading information or produce a false or misleading document (see Criminal Code, pt 3.4).
