51 Appointment of contact person

(1)

The individual must appoint 1 person to be the individual’s contact person.

(2)

A person can be appointed as the contact person for an individual only if the person—

(a)

is an adult; and

(b)

consents to being appointed as the contact person for the individual.

(3)

Without limiting who can be appointed as the contact person, the individual may appoint their coordinating practitioner or consulting practitioner.

(4)

The appointment must—

(a)

be in writing; and

(b)

be prepared by—

(i)

the individual; or

(ii)

if the individual is unable to prepare the appointment—another person who is an adult and is asked by the individual to prepare it; and

(c)

include any information prescribed by regulation.

(5)

The appointment takes effect when the individual gives their coordinating practitioner the appointment.

(6)

The individual’s coordinating practitioner must give the board a copy of the appointment within 4 business days after the day the coordinating practitioner receives the appointment.

Maximum penalty: 20 penalty units.

(7)

An offence against this section is a strict liability offence.
