64W Requirement for supply arrangement with scheme coordinator and container approval
(1)
A supplier commits an offence if—
(a)
the supplier supplies or offers to supply a beverage in a container to another person; and
(b)
the following are not in force:
(i)
a supply arrangement between the supplier and the scheme coordinator for the class of container to which the container belongs;
(ii)
a container approval granted to the supplier for the class of containers to which the container belongs.
Maximum penalty: 1 000 penalty units.
(2)
Strict liability applies to subsection (1) (b).
