21 Meaning of protected information
Relevant information is protected information if:
(a)
it is personal information; or
(b)
it is information (including commercially sensitive information) the disclosure of which could reasonably be expected to found an action by an entity (other than the Commonwealth) for breach of a duty of confidence.
Note:
Under the Privacy Act 1988, sensitive information (within the meaning of that Act) may be personal information. Information is not personal information if it is only about a person who has died.
