34P Notice of proposed suspension or cancellation to be given to holder
The APVMA must not suspend or cancel an approval or registration unless it has given the holder a written notice that:
states that the APVMA proposes to suspend or cancel the approval, or suspend or cancel the registration, as the case may be; and
sets out the reasons for the proposed suspension or cancellation; and
invites the holder to make, within a reasonable period specified in the notice, submissions to the APVMA in relation to the proposed suspension or cancellation.
The APVMA must not make a decision relating to the proposed suspension or cancellation, as the case may be, until it has had regard to any submission made by the person in response to an invitation under paragraph (1)(c).
A written notice under subsection (1) must specify the period of the suspension.
Subsection (1) does not apply to a suspension or cancellation under section 34AA, 35A, 39 or 42.
