21 No grant of lease if Part 3 contravened
The Commonwealth must not grant an airport lease to a company if the Minister is satisfied that:
an unacceptable foreign‑ownership situation in relation to the company would come into existence in the event of the grant; or
an unacceptable airline‑ownership situation in relation to the company would come into existence in the event of the grant; or
both:
the company would become a member of a pair of airport‑operator companies in the event of the grant; and
an unacceptable cross‑ownership situation in relation to the pair would come into existence in the event of the grant.
If a purported grant contravenes this section, it is of no effect.
