85 Notification of matters that may affect the achievement of final master plan

(1)

If:

(a)

a final master plan for an airport is in force; and

(b)

the airport‑lessee company for the airport becomes aware that a particular matter may significantly affect the achievement of the plan;

the company must, within 60 days after it becomes aware of that matter, give the Minister a written notice:

(c)

setting out particulars of the matter; and

(d)

explaining the effect of the matter on the achievement of the plan.

(2)

A company commits an offence if:

(a)

the company is required to give a written notice under subsection (1); and

(b)

the company engages in conduct; and

(c)

the company’s conduct contravenes the requirement.

Penalty: 100 penalty units.

(3)

Strict liability applies to paragraph (2)(a).
