17 FAC land leased to the Commonwealth
(1)
This section applies to land:
(a)
in which the FAC had any right, title or interest; and
(b)
that was leased to the Commonwealth.
(2)
If the FAC’s right, title and interest in the land vests in the Commonwealth under this Part, the Commonwealth’s interest under the lease does not merge in the greater estate or interest that becomes vested in the Commonwealth under this Part.
Note:
This means, in effect, that the Commonwealth will be treated as if it had leased the land to itself. When an airport lease is granted, the lessee of the lease referred to in paragraph (1)(b) will become the lessee of the airport‑lessee company.
