26 Alteration of Commonwealth records

(1)

A person commits an offence if:

(a)

a Commonwealth record has been in existence for more than 15 years; and

(b)

the person engages in conduct; and

(c)

the person’s conduct results in an addition to or an alteration of the record.

Penalty: 20 penalty units.

(1A)

Strict liability applies to paragraph (1)(a).

Note:

For strict liability, see section 6.1 of the Criminal Code.

(2)

Subsection (1) does not apply to anything done:

(a)

as required by any law; or

(b)

with the permission of the Archives or in accordance with a practice or procedure approved by the Archives.
