Transfer of certain Commonwealth records to care of Archives
27 Transfer of certain Commonwealth records to care of Archives
This section applies to a Commonwealth record that:
is in the custody of a Commonwealth institution other than the Archives; and
has been determined to be part of the archival resources of the Commonwealth under section 3C.
In certain circumstances a Commonwealth institution or Minister can exempt a record from this section (see section 29).
The person responsible for the custody of the record must cause the record to be transferred to the care of the Archives in accordance with arrangements approved by the Archives.
The record must be transferred:
if the record ceases to be a current Commonwealth record—as soon as practicable after the record ceases to be a current Commonwealth record; and
in any event—within 15 years of the record coming into existence.
