21 When the Minister is taken to have given approval for negotiations

(1)

This section applies if:

(a)

a core State/Territory entity gives the Minister a notice under subsection 16(1) about its proposal to negotiate an arrangement with a core foreign entity; and

(b)

the Minister has not made a decision under subsection 17(2) or (3) within the 30‑day period that starts on the day the notice is given.

(2)

The Minister is taken to have given approval under this subsection for the negotiation proceeding.

Note:

The Minister’s approval under this subsection may not be revoked.

(3)

The Minister’s approval under subsection (2) comes into force immediately after the end of the period referred to in paragraph (1)(b).

(4)

The Minister may no longer make a decision under section 17 about the negotiation.
