27 Notice of the Minister’s refusal under subsection 24(3)

As soon as practicable after making a decision under subsection 24(3) to refuse to give approval for a core State/Territory entity entering an arrangement with a core foreign entity, the Minister must give the core State/Territory a written notice that states:

(a)

the Minister’s decision; and

(b)

if the Minister considers that changes could be made to the arrangement that could allow the Minister to give approval for the core State/Territory entity entering an arrangement with the core foreign entity—the Minister’s recommended changes.

Note:

If the core State/Territory entity agrees to the Minister’s recommended changes, the entity could decide to give a new notice under subsection 23(1) for a new arrangement with the core foreign entity that incorporates those changes.
