37 Compliance by Australia with emissions trading eligibility requirements under the Kyoto rules
Declaration
If the Minister is satisfied that Australia is in compliance with the eligibility requirements mentioned in paragraph 2 of the Annex to Decision 11/CMP.1 of the Meeting of the Kyoto Parties, the Minister must, by writing, declare that Australia is in compliance with the emissions trading eligibility requirements under the Kyoto rules.
Revocation of declaration
If:
a declaration is in force under subsection (1); and
the Minister is not satisfied that Australia is in compliance with the eligibility requirements mentioned in paragraph 2 of the Annex to Decision 11/CMP.1 of the Meeting of the Kyoto Parties;
the Minister must, by writing, revoke the declaration.
Declaration or revocation is not a legislative instrument
An instrument made under subsection (1) or (2) is not a legislative instrument.
