130 Representative for the Commonwealth in proceedings

(1)

If proceedings are brought against the Commonwealth for an offence or contravention of a civil penalty provision of this Act, the Minister may be specified in any document initiating, or relating to, the proceedings.

(2)

The Minister in relation to an offence or civil penalty provision is entitled to act in proceedings against the Commonwealth for the offence or provision and, subject to any relevant rules of court, the procedural rights and obligations of the Commonwealth as the accused or defendant in the proceedings are conferred or imposed on the Minister.
