142 Delegation by the Director‑General

(1)

The Director‑General may, by instrument in writing, delegate any of the Director‑General’s functions (other than those under section 72, 73, 105, 107, 123 or 144) to:

(a)

the Deputy Director‑General; or

(b)

a person who:

(i)

is an SES employee or an acting SES employee, or holds or is acting in a position that is equivalent to a position occupied by an SES employee, in the Regulator; and

(ii)

is not a member of the Australian Defence Force.

Note:

The expressions SES employee and acting SES employee are defined in the Acts Interpretation Act 1901.

(2)

In exercising functions under a delegation, the delegate must comply with any directions of the Director‑General.
