60 Entering certain premises for access to investigation area
An inspector may enter any premises (other than premises used as a residence) to gain access to an investigation area for the purposes of section 47.
Subsection (1) does not authorise an inspector to enter premises unless the inspector has shown the inspector’s identity card if required by the occupier of the premises.
However, an inspector is not required to comply with subsection (2) if the inspector reasonably believes that immediate entry to the premises is required to ensure the safety of an individual.
If:
an inspector does not comply with subsection (2) because of subsection (3); and
the occupier of the premises is present at the premises;
the inspector must show the inspector’s identity card to the occupier as soon as practicable after entering the premises.
To avoid doubt, an inspector may not enter premises under this section if the premises is an investigation area.
