34DN Interpreter provided at request of prescribed authority

(1)

This section applies if:

(a)

the subject of a questioning warrant appears before a prescribed authority for questioning under the warrant; and

(b)

the prescribed authority believes on reasonable grounds that the subject is unable, because of inadequate knowledge of the English language or a physical disability, to communicate with reasonable fluency in that language.

(2)

A person exercising authority under the warrant must arrange for the presence of an interpreter.

(3)

The prescribed authority must:

(a)

defer informing the subject under section 34DC and, if applicable, section 34DD until the interpreter is present; and

(b)

give a direction under paragraph 34DE(1)(d) deferring questioning of the subject under the warrant until the interpreter is present.
