35D Contents of special intelligence operation authorities
A special intelligence operation authority must:
state how the special intelligence operation will assist the Organisation in the performance of one or more special intelligence functions; and
identify the persons authorised to engage in special intelligence conduct for the purposes of the special intelligence operation; and
state a description of the nature of the special intelligence conduct that the persons referred to in paragraph (b) may engage in; and
specify the period of effect of the special intelligence operation authority, being a period not exceeding 12 months; and
specify any conditions to which the conduct of the special intelligence operation is subject; and
state the date and time when the special intelligence operation authority is granted.
A person is sufficiently identified for the purposes of paragraph (1)(b) if the person is identified:
by an assumed name under which the person is operating; or
by a code name or code number;
as long as the person’s identity can be matched to the assumed name, code name or code number.
