74 Publishing failure to participate in alternative dispute resolution process
The Ombudsman may publicise, in any way that the Ombudsman thinks appropriate, either or both of the following:
that an entity who is a party to a dispute in relation to a relevant action has refused to engage in an alternative dispute resolution process, or alternative dispute resolution processes, of the kind recommended by the Ombudsman under paragraph 71(2)(a);
that an entity who is a party to a dispute in relation to a relevant action has withdrawn from an alternative dispute resolution process, or alternative dispute resolution processes, of the kind recommended by the Ombudsman under paragraph 71(2)(a).
This section does not:
limit the power of the Ombudsman or anyone else to publicise a matter or a person’s name; or
prevent anyone else from publicising a matter or a person’s name; or
affect any obligation (however imposed) on anyone else to publicise a matter or a person’s name.
