21 Debtor’s petition—filing of trustee’s consent

If:

(a)

a debtor presents, or 2 or more debtors present, a petition to the Official Receiver under section 55, 56B or 57 of the Act; and

(b)

there is in force under subsection 156A(1) of the Act an instrument of consent of a registered trustee to act as the trustee of:

(i)

the estate of the debtor; or

(ii)

in the case of 2 or more debtors—the separate estates, the joint estates, or the joint and separate estates, of the debtors or any of them;

the petition must include the original, or a clearly legible copy, of the instrument of consent.
