14C Transfer of Supreme Court jurisdiction
This section applies to the jurisdiction vested in the Supreme Court of the Territory or a Judge of that Court immediately before the transfer day, except in relation to matters for which:
proceedings were pending in that Court immediately before that day; or
proceedings had been completed in that Court before that day.
On and after the transfer day, the jurisdiction:
ceases to be vested in the Supreme Court of the Territory or a Judge of that Court; and
is vested in:
if the Family Court of Western Australia or a Judge of that Court would, apart from this section, have the jurisdiction under subsection 14B(1)—the Family Court of Western Australia or a Judge of that Court (as the case requires); or
if the District Court of Western Australia or a Judge of that Court would, apart from this section, have the jurisdiction under subsection 14B(1)—the District Court of Western Australia or a Judge of that Court (as the case requires); or
in any other case—the Supreme Court of Western Australia or a Judge of that Court (as the case requires).
