22 Consequences for providing false or misleading information or documents
(1)
A person commits an offence if:
(a)
the person gives information or produces a document to a person or body; and
(b)
the person does so in response to a condition imposed on a return permit given to the person; and
(c)
the person does so knowing that the information or document is false or misleading.
Penalty: Imprisonment for 2 years.
(2)
Subsection (1) does not apply if the information or document is not false or misleading in a material particular.
Note:
A defendant bears an evidential burden in relation to the matter in this subsection (see subsection 13.3(3) of the Criminal Code).
