Dairy Industry Service Reform Act 2003

A transferring DRDC employee is taken:

to have been engaged by Dairy Australia Limited on the same terms and conditions as those that applied to the person, immediately before the conversion time, as an employee of DRDC; and

to have accrued an entitlement to benefits, in connection with that engagement by Dairy Australia Limited, that is equivalent to the entitlement that the person had accrued, as an employee of DRDC, immediately before the conversion time.

The service of a transferring DRDC employee as an employee of Dairy Australia Limited is taken, for all purposes, to be continuous with his or her service as an employee of DRDC.

Except as provided by this Division, a transferring DRDC employee is not entitled to receive any payment or other benefit merely because of the operation of this Division.

Except as provided by this Division, a transferring ADC employee is not entitled to receive any payment or other benefit merely because of the operation of this Part.

This section:

has effect subject to this Division; and

is not to be taken to be a law of the Commonwealth for the purposes of paragraph 170XA(2)(b) of the Workplace Relations Act 1996, as in force immediately before the reform commencement within the meaning given by that Act.
