227 Conditions of export permit
An export permit is subject to:
any conditions prescribed by the rules; and
any additional conditions specified in a written notice given to the holder of the permit.
An export permit may be revoked if conditions of the permit are contravened (see section 233).
Conditions prescribed by rules made for the purposes of paragraph (a) may be varied by amending the rules. Any additional conditions of an export permit specified in a notice given under paragraph (b) may be varied by the Secretary under section 229.
Without limiting paragraph (1)(a) or (b), the rules may prescribe conditions, and the Secretary may impose conditions, that are required to be complied with before or after the export of the goods to which the export permit relates.
For the purposes of this Act, conditions to which an export permit is subject under subsection (1) are conditions of the permit.
Fault‑based offence
A person commits an offence if:
the person is the holder of an export permit that is in force; and
the person engages in conduct; and
the conduct contravenes a condition of the permit.
Penalty: Imprisonment for 2 years or 120 penalty units, or both.
Civil penalty provision
A person is liable to a civil penalty if:
the person is the holder of an export permit that is in force; and
the person contravenes a condition of the permit.
Civil penalty: 240 penalty units.
