12 Forfeiture of recognizance
If any of the following is satisfied that a person admitted to bail in a State or Territory in relation to a proceeding under the Act has failed to comply with the conditions of the recognisance upon which the person was admitted to bail:
a Magistrate in the State or Territory;
an eligible Judge;
a Judge of the Supreme Court in the State or Territory;
the Magistrate, the eligible Judge or the Judge of the Supreme Court may, by order, declare the recognisance to be forfeited.
If the recognisance has been declared to be forfeited, a court having jurisdiction in the State or Territory in which the recognisance was declared to be forfeited may enforce payment of any amount due under the recognisance by a person residing in that State or Territory.
An amount recovered pursuant to this section shall be transmitted to the Attorney‑General of the Commonwealth.
