10.05 Service on partnership

(1)

A document that is to be served personally on a partnership must be served:

(a)

on any one or more of the partners; or

(b)

at a place where the partnership business is carried on, by leaving a copy of the document with a person who:

(i)

is apparently an adult; and

(ii)

appears to be engaged in the service of the partnership.

(2)

Service of the document is taken to be service on each partner of the partnership, including any partner who was not in Australia at the time the proceeding was started.

(3)

If the applicant is aware that a partnership has been dissolved before the proceeding was started, a document must be served on any person:

(a)

against whom a claim is made in the proceeding; and

(b)

who the applicant is aware was a partner in the partnership at the time that the cause of action arose.
