14.13 Interim distribution of property or income from property
If a proceeding concerns property, a party may apply to the Court for an order that:
(a)
the property be conveyed, transferred or delivered to a person having an interest in the property; or
(b)
the income, or a part of the income, from the property be paid, during a specified period, to a person having an interest in the income.
Note:
In considering whether to make an order under rule 14.13, the Court will take into account whether an order would defeat a party’s claim or defence.
