36.55 Written submissions, chronology and lists of authorities

(1)

Each party to an appeal must file the following documents:

(a)

an outline of the party’s submissions on the appeal;

(b)

an updated outline of the party’s submissions on the appeal cross‑ referenced to the appeal book filed under rule 36.56;

(c)

a chronology of the relevant events;

(d)

an updated chronology of the relevant events cross‑referenced to the appeal book filed under rule 36.56;

(e)

a list of authorities to which the party intends to refer;

(f)

a list of any legislation to which the party intends to refer.

(2)

The documents mentioned in paragraphs (1)(a) and (c) must be filed as follows:

(a)

for an appellant—not later than 25 business days before the hearing of the appeal;

(b)

for a respondent—not later than 20 business days before the hearing of the appeal;

(c)

for an appellant making submissions in reply—not later than 15 business days before the hearing of the appeal.

(3)

The documents mentioned in paragraph (1)(b) and (d) must be filed not later than 5 business days before the hearing of the appeal.

(4)

The documents mentioned in paragraphs (1)(e) and (f) must be filed as follows:

(a)

for an appellant—not later than 5 business days before the hearing of the appeal;

(b)

for a respondent—not later than 4 business days before the hearing of the appeal.

Note:

The Court has issued a Practice Note for the assistance of parties to an appeal and their lawyers. The Court expects the parties and their lawyers to comply with the Practice Note.
